Here’s a comprehensive Terms & Conditions outline for clientele usage , customized for meal preps, culinary classes, and event services.
1. Parties & Scope
- Parties Involved: Hayes At Home and the Client with full legal names, addresses, and contact information
- Services Included: Define which services are covered—meal prep, culinary classes, event catering—with event date, location, type of service (buffet, plated, class, delivery), and guest/participant counts .
2. Fees & Payments
- Pricing: List cost per meal/subscription/package, class fee per person, and event catering per guest or package.
- Deposit: Non-refundable deposit required upon booking (e.g., 25–50%) to secure date .
- Balance: Payment schedule—e.g., final payment due 14 days before event or class date.
- Extra Charges: Overtime hours, last-minute guest additions or menu changes (e.g., >10% of guest count), cost adjustments for ingredient market fluctuations
3. Client Obligations
- Guest Finalization: Client must confirm guest numbers or participant count a specified number of days ahead (e.g., 7–14 days) .
- Venue Access: Provide access to event/class location a few hours prior; ensure electricity, water, waste, and suitable setup.
- Dietary Info: Share allergies or restrictions by the guest-count deadline.
4. Cancellation & Changes
- Client Cancellation:
- Cancel more than 14 days before: lose deposit only.
- Cancel within 14 -21 days prior : liable for 50–100% of total fee
- Rescheduling: Subject to availability; deposit can roll over.
- Force Majeure: No liability for cancellations due to unforeseen events (e.g. pandemics, natural disasters)
5. Caterer Responsibilities
- Food Preparation: Fresh, safe, in compliance with local health regulations.
- Staff & Equipment: Supply chefs, servers, utensils, tableware, linens, and any agreed equipment
- Insurance: Maintain liability insurance; caterer responsible for damage caused by its negligence
6. Liability & Indemnification
- Caterer Liability: Caterer not liable for injury or loss unless due to its negligence.
- Client Indemnity: Client indemnifies caterer against claims from attendees or third parties
- Insurance: Caterer holds general liability insurance; client encouraged to carry event insurance.
7. Miscellaneous
- Independent Contractor: Caterer is not an employee of the client.
- Amendments: Changes only valid if written and signed by both parties.
- Governing Law: State/national jurisdiction clause.
- Severability: Invalid terms don’t invalidate the rest.
- Entire Agreement: Supersedes prior communications.
- Minimum Guarantee: A minimum guest count applicable or client pays for minimum even if fewer guests attend
- Overage/Underspend Fees: Charged based on final headcount.
